</B>DUROPOWER LIGHTING Limited Warranty BallastWise<B> DUROPOWER INC. ("DPI") warrants DUROPOWER Electronic Ballast to be free from defect in material and workshop, subject to the terms and conditions below, for a period of sixty (60) months, beginning from the date of manufacture. This warranty is conditioned upon proper storage, use and maintenance of the DUROPOWER Ballasts. This warranty is not applicable to any DUROPOWER ballast that is not properly stored or maintained, that is altered in any way, or that is not installed and operated in accordance with current National Electric Code ("NEC"), Underwriters' Laboratory, Inc ("UL"), and American National Standards Institute ("ANSI") standards and specifications, and in accordance with instructions and guidelines for the DUROPOWER ballast supplied by DPI. This warranty is also not applicable to any DUROPOWER ballasts subjected to abnormal stresses and operating conditions. Any repair of any DUROPOWER ballast without DUROPOWER'S written approval or replacement of any part or parts of any DUROPOWER ballasts with any part or parts not provided by DPI will void the entire warranty. DUROPOWER INC. will correct any defects in a DUROPOWER ballast, at DPI'S option, by either repairing or replacing any defective part or parts or by making a replacement DUROPOWER ballast available. Unless otherwise stipulated DPI will examine all DUROPOWER ballast said to be defective and reserves the right to be the sole judge as to whether any DUROPOWER ballast are defective and covered under this warranty. This express limited warranty is extended by DPI only to the original purchaser. DUROPOWER INC. will reimburse the purchaser reasonable, customary and necessary labor charges required to install the ballast replacement. Labor option must be pre-approved by DPI. Any labor options or cost that is not pre-approved will not be eligible for the reimbursement. WARRANTY CLAIMS: Warranty claims can be made by contacting 1-866-433-9468 to initiate the process for the problem resolution. All warrant claims must include return address. If so instructed, the purchaser shall, at purchaser's expenses, ship the DUROPOWER unit claimed to be defective to the address provided in reply to purchaser's claims. The foregoing warranty shall constitute the sole and exclusive remedy at the purchaser and the sole and exclusive liability of DPI. NO WARRANTY OF MERCHANTADILITY OR FOR A PARTICULAR PURPOSE IS MADE OR TO BE IMPLIED. The foregoing warranty is exclusive of all other statutory, written or oral warranties, and no other warranties of any kinds, statutory or otherwise, are given or herein expressed. This warranty sets forth DPI'S responsibilities regarding the tamp ballast and purchaser's exclusive remedy. LIMITATION OF LIABILITY: Under no circumstances, whether as a result of breach of contract, breach of warranty, tort, strict liability or otherwise, will DPI be liable for consequential, incidental, special or exemplary damages including, but not limited to, loss of profit or revenues, loss of use of ballast or any other goods or associated equipment, cost of capital, cost of substitute products, facilities or service, down time costs, or claims of purchaser's customers, DUROPOWER'S liability to any claim of any kind for any loss or damages arising out of, resulting from or concerning any aspect of this warranty or from the DUROPOWER ballast shall not exceed the price of the specific DUROPOWER ballast shall not exceed the price of the specific DUROPOWER ballast which gives rise to the claim. DUROPOWER INC. reserves the right to examine all failure ballasts and reserves the right to be the sole judge as to whether any ballasts are defective and covered under this warranty.
